COMMISSION POLICY
Article 59 of Government Procurement Act of Republic of China, which was promulgated by the President of Republic of China on May 27, 1998, includes the following provision at Clause 2: "A supplier shall not induce the procuring entity to sign a contract by giving others commission, percentage, brokerage, kickback, or any other benefits." Note, however, that Article 82 of Enforcement Rules of the Gioverment Procurement Act provides that "Paragraph 2 of Article 59 of the Act shall not apply to a payment incurred by a proper commerical transaction. "
